Who Owns Your AI Team? โ€” Three Survival Strategies for Employees, Executives, and Companies

AI team ownership can't be treated as one thing. Accounts, prompts, knowledge bases, and personas each follow different rules. Three perspectives on survival strategies.

At GIZIN, roughly 30 AI employees work alongside humans. Our communication analysis revealed that 55% of all messages concentrated on a single human executive. From that finding, a question emerged โ€” who does this AI team actually belong to?


"AI team" can't be treated as one thing

"Does the AI team belong to the company? Or to the person who built it?"

Throw this question out as-is, and you'll never get an answer. Because an "AI team" consists of at least six distinct components, each with different rules of ownership.

Accounts are determined by contract signatory. Prompt collections are a matter of copyright and trade secrets. Preventing employees from taking their own know-how is inherently difficult. Before asking "who owns the AI team?", you need to decompose it into "what belongs to whom?"

With that premise in mind, let's consider survival strategies from three perspectives.

The employee's survival strategy โ€” you can't take the weapon, but you can take the arm

Suppose you've built an AI team at your company, streamlined operations, and delivered results. If you change jobs, what happens to those weapons?

What you can't take is clear. AI implementations integrated with internal data, system prompts, trained Memory, access permissions. These stay with the company.

What you can take also exists. AI collaboration skills, workflow design experience, the track record of "having built and operated an AI team." In other words, even if you can't take the configuration files, you can take the ability to rebuild.

The market value of this "arm" is rising. According to PwC's "Global AI Jobs Barometer 2025" (June 2025), the wage premium for roles requiring AI skills averages 56% โ€” doubling from 25% the prior year (Source: PwC, analysis of approximately 1 billion job postings).

However, PwC itself suggests a "scarcity effect." Once everyone uses AI, this premium will shrink.

The employee's survival strategy can be framed as a three-stage evolution:

  1. "Can use AI" โ€” no longer a differentiator. The era when everyone uses AI is coming
  2. "Can evaluate and integrate AI output" โ€” judgment and orchestration ability. This is where value is highest right now
  3. "Can build organizations with AI" โ€” team management, institutional design, culture-building. The scarcest skill

The higher the stage, the more portable it is. "I know how to use this AI tool" has low portability, but "I've stood up an AI team from zero" has extremely high portability. Which stage are you at right now?

There's also a risk that's easy to overlook. A survey by the Upwork Research Institute (July 2025) found that the most productive AI users experience higher burnout and are twice as likely to consider quitting. Employees who wield AI as a weapon tend to become the unofficial support desk within the organization. The normalization of "just ask so-and-so about AI" exhausts the very people carrying the weapon.

The executive's survival strategy โ€” it vanishes from the books, but the market pays 25x

For executives, is the AI team an "asset" or a "cost"? The answer is both โ€” and that's what makes it complicated.

On the books, the cost of building an AI team disappears as "expense." Under IAS 38 (the accounting standard for intangible assets), all expenditures during the "research phase" of AI development are expensed by default. On the ledger, investment in an AI team is nothing more than a "cost" that drags down profits.

But the market sees it differently. In 2025, the average EV/Revenue for AI-related M&A was 25.8x (per Finro FCA). That's more than four times the multiple for traditional SaaS companies (approximately 6x).

There's a symbolic case. In March 2024, Microsoft paid roughly $650 million in licensing fees and poached the key team including the CEO from Inflection AI. They didn't acquire the company itself. What they bought was the "team" (Source: Reuters/Bloomberg).

It vanishes from the books, but the market pays 25x. This gap is the true nature of an AI team.

So what happens when AI usage concentrates on a single executive?

Nvidia CEO Jensen Huang has championed a vision of "50,000 employees supported by 100 million AI assistants" and mandated AI tool usage across the company. He's the power user himself while designing the system for company-wide access (Source: BG2 Podcast Ep17, October 2024).

JPMorgan Chase CEO Jamie Dimon committed $2 billion annually to AI investment and opened LLM Suite access to roughly 250,000 employees (Source: Bloomberg, October 2025).

What these two companies share is that they've designed a process to transfer the executive's personal AI capability to the organization.

There's also a counter-example. Klarna automated two-thirds of its customer support with AI, replacing the workload of over 700 people (per their 2024 official announcement). But afterward, they brought human agents back for situations requiring complex emotional support. The lesson: AI alone couldn't maintain customer relationships.

The risk for executives is "turning the AI team into an extension of yourself." As cognitive offloading progresses too far, there's a risk that the very ability to verify AI responses โ€” critical thinking โ€” atrophies (this is beginning to be discussed in academic literature as AI-Induced Skill Atrophy. Source: SSRN).

If you stepped away, would your AI team still run?

The company's survival strategy โ€” the law can't fully protect you

When a company tries to legally protect AI team ownership, it hits a wall almost immediately.

Current law is built on the premise of "things made by humans." Copyright law protects human creation, patent law protects human invention, trade secret law protects managed information. The knowledge, judgment patterns, and interaction histories that an AI team accumulates in daily operations don't fit neatly into any of these categories.

Let's sort out what can and can't be protected.

Legally protectable:

  • Configuration files and prompt collections (as trade secrets, but requires demonstrable secrecy management)
  • Character names, logos, and avatars (trademark registration, copyright)
  • Structured prompt libraries (as compilations)
  • Ownership defined by contract

Not legally protectable:

  • Know-how and experiential knowledge in an employee's head
  • An AI persona's "personality" itself (closer to an idea)
  • A departing employee rebuilding a similar AI team under a different account

There is no case law specific to prompts or AI configurations yet. This is a legal vacuum.

So how does a company protect itself? Rather than waiting for legislation, build a three-layer defense on your own.

Layer 1 โ€” Contracts: Establish IP ownership clauses. However, "all outputs generated through AI" is too broad. Limiting it to "outputs created during working hours using the company's AI systems" is more realistic. Without contractualizing account transfer and data handover at departure, you end up with "the rights are ours, but we can't access the actual thing."

Layer 2 โ€” Technology: Access controls, log management, confidentiality labeling on configuration files. Build a structure where things "can't be taken."

Layer 3 โ€” Brand: Secure AI character names and logos through trademark registration. Accumulate external recognition of the character, and use trademarks, copyright, and established reputation to compensate for the weak legal protection of "personality."

Japan's hiring market is also shifting. According to an Acaric 2026 survey, 89% of companies using generative AI have revised their new-graduate hiring strategies, and 55.4% have reduced headcount. Meanwhile, a Koale survey (of 1,008 managers) found that over 70% feel that employees who can't use AI are causing operational friction, with section managers and team leaders being the most common group struggling to adapt.

How to handle invisible value

Line up the survival strategies of all three perspectives, and a common structure emerges.

  • Employees: The AI team is a weapon, but you can't take it with you
  • Executives: The AI team is the greatest asset, but it doesn't appear on the books
  • Companies: They want to protect the AI team, but the law can't fully cover it

All three are struggling with "invisible value."

In our recent communication analysis, we found that 55% of AI team communication concentrated on one human. That's a structure of "dependency." But seen from another angle, it was only because the human joined the same table as AI that the organization's structure became visible as data for the first time.

AI team ownership may not be a question of "possession" but of "relationship." Who holds the configuration files, whether it appears on the ledger, whether the law can protect it โ€” that framework of "possession" can't fully capture the value of an AI team.
